The present Terms and Conditions represent a binding agreement between the user and “Bono Georgia“ LLC (hereinafter referred to as the "Company"). It regulates the use of the Bono application platform and sets out standards for collecting/storing User Personal Data by the company.
This Agreement shall be deemed concluded upon the expression of electronic consent by the user.
Article 1. Definition of terms
1.1 Agreement – the present terms and conditions.
1.2 Application - „Bono“ application for mobile phones.
1.3 Company – - „Bono Georgia“ LLC, owner of „Bono“ application;
1.4 Partner company - an individual legal entity, which shares the user data (accumulated/spent points) available in its accumulation system with "Digital System Georgia" LLC for the purpose of reflecting points in the application.
1.5 Electronic wallet (e-wallet) – an electronic money (e-money) account registered in the name of the user, which is available in the Bono application and allows the user to use e-money in the manner specified herein.
1.6 User - a natural person, authorized to use the application as per this agreement.
1.7 Registration – entering the mandatory personal data in the application by the user in order to spend the points he/she accumulates in the app.
1.8 Personal data - personal data of the user, required for registering in the application - name, surname, date of birth, personal number and mobile phone number.
1.9 Registered verified user - a user who has filled in the required fields while registering in the application and has passed verification with a mobile phone number.
1.10 Unregistered user - a user who is not registered in the application and accumulates points through QR code generated by the application.
1.11 Known user - a user who has passed verification in the app and whose data have fully matched with those in the partner companies.
1.12 Unknown user – a user, who has passed verification in the application, though some of his/her data do not match with those in the partner companies.
1.13 Additional identification – to confirm identity in case of an unknown user, a person shall upload a photo of himself/herself holding his/her identity document in the application system.
1.14 One-time code - a code received on the mobile phone number specified while registering in the application, which should be entered to complete the registration and verify the user.
1.15 Active account – user account, where points accrue.
1.16 Passive account – user account, where accrual of points is suspended for some reason.
1.17 Point - a non-monetary advance unit, which the user earns in the application system upon making a purchase in a partner company.
1.18 QR code - a unique barcode used in the application, through which points and/or e-money are accumulated/spent, topped up, or other transactions are carried out (as well as user or merchant identification is performed).
1.19 Statement - information about balances and operations carried out on the user's account in a certain period of time.
1.20 Point tracking - accumulation of points by consolidating the data of QR code and the data provided by partner companies.
1.21 Catalog – the page of the application, which displays the available facilities for spending points.
1.22 Utilization of points – purchasing various products and services through the application with available points.
1.23 Open banking
Article 2. General rules
2.1 Any citizen of Georgia, full of age, is eligible to use the application.
2.2 When opening the application for the first time, a user gets informed about the terms and conditions of using the application that he/she must accept in order to use the app.
2.3 By accepting the terms and conditions, the agreement is deemed concluded between the parties.
2.4 While registering, a user shall fill in mandatory fields such as: first name, last name, date of birth, personal number and mobile phone number.
2.5 By agreeing to this agreement, the user confirms that the information he/she enters at the time of registration represents his/her own personal data that is accurate and correct.
2.6 The company shall not be held liable for any negative consequences arising from inappropriate entry of data by the user and/or failure to adjust the data, if changed.
2.7 During registration, the user shall enter his/her own personal data. In case of entering someone else’s or wrong data, the responsibility for any negative consequences shall rest with the user.
2.8 By agreeing to this agreement, the user authorizes the company to:
a) check his/her personal data in the user database of partner companies and in case of finding matches, reflect accumulated points in the application system.
b) in case of subsequent change of points, check/share data and relevant transaction information with partner companies.
c) exchange non-personalized information with partners.
d) users may get personalized offers from "Bono", or from partner companies in „Bono“ application, or through social network accounts of "Bono" and partner companies.
2.9 After accepting the terms and conditions of the application, a user may use the accumulation system of the app without undergoing registration - as an unregistered user.
2.10 To spend points, a user should register in the application and get the status of a registered verified user.
2.11 An unknown user shall undergo additional identification in order to get the status of a registered verified user.
2.12 Once additional identification is successfully completed and approval of the partner company is secured, the points accumulated in the partner company will be reflected in the application.
2.13 If the user does not agree with the number of points, he/she may contact the application hotline to verify the data.
2.14 In case of technical disruption or force majeure, the company is entitled to temporarily suspend the service up to the time such circumstances are eliminated.
Article 3. Accumulation of Points
3.1 A user may collect points in Bono application via personal number, unique QR code or QR/barcode on a fiscal receipt or product.
3.2 To accumulate points via personal number, the user shall tell his/her personal number to the operator of the partner company, after which the user will be informed about the number of points accrued and reflected on his/her account in the Bono app.
3.3 If the user is not registered in the application, the information about his/her personal number and the points collected will be stored. After registration, the accumulated points will be credited to the account of the user in Bono application.
3.4 To accumulate points through QR code, a user shall provide the operator of the partner company with the unique QR code opened in the personal account of the Bono application. After scanning the code, the accumulated points will be reflected on the user's account.
3.5. To accumulate points through QR/barcode on a fiscal receipt or product, a user shall scan QR code/barcode in Bono app. As a result, points will accrue to the user.
Article 4. Utilization of points
4.1 A user of the Bono application has the opportunity to spend the accumulated points. To this end, several methods are available: spending the points in the app and spending the points in partner merchants’ network/digital channel. The methods of spending points include spending points directly in the app, spending with a personal number, spending points with QR/barcode, and spending points with a one-time code.
4.2 Direct spending of points in the app means exchanging them for a corresponding product/service available in the catalog of the Bono application.
4.3 If the user wants to spend points with a personal number, the user shall express his/her desire to spend the points accumulated in the Bono application to the partner company; in this case, the user's personal number and one-time code will be used to verify whether the user has enough points accumulated and, if so, the points will be expensed as per the user's preference.
4.4 If the user wants to spend points with a QR/barcode:
a) the user shall express his/her desire to spend the points accumulated in the Bono application to the partner company; to this end, he/she shall generate a dynamic QR/barcode in the application; after scanning the code or indicating the Latin characters and numbers corresponding to the barcode, a representative of the partner company or a digital system will check whether the user has enough points accumulated and if so, the points will be expensed as per the user's preference;
b) a representative of the partner company or the digital system generates a dynamic QR/bar code corresponding to the user's cart/order, which the user scans through the application and confirms the payment in the very app; the user's points are spent accordingly.
5.1 E-wallet is an electronic money account registered in the name of the user, which is available in the Bono application and provides for the use of e-money in the manner specified herein.
5.2 E-wallet belongs to the user of the Bono application only. It is inadmissible to alienate, transfer ownership or pledge the electronic wallet.
5.3 E-wallet is registered for an indefinite period.
5.4 E-wallet has an electronic money account in one currency and in all cases - in GEL.
5.5 The electronic money in the e-wallet represents the nominal value of cash the provider gets from the user, which is deposited in the electronic wallet and which the user keeps, withdraws or disposes of in the manner defined herein.
5.6 Electronic money may be kept in the e-wallet permanently, until it is cashed out or otherwise disposed of by the user.
5.7 Top-up of the wallet through wire transfer: a user can top up the wallet from the branches of commercial banks in Georgia, or through Internet banking. To top up the wallet, the user should provide/specify "Bono Pay" LLC bank account number, with "C Bono Pay" LLC indicated as the recipient and put the name, surname and personal number of the wallet owner in the purpose.
5.8 Top-up of the wallet through open banking – a user may link the accounts he/she has in the partner bank(s) with the Bono application, from which he/she will be able to top-up the wallet. To link bank accounts with the Bono application, confirmation should be given through the internet bank of the partner bank.
5.9 In case if the client deposits money from the bank account, the amount will be reflected in the personal account of the client according to the system of the bank working hours.
5.10 After registering in the Bono application, a user's electronic wallet (hereinafter "e-wallet") will be created in the name of the user. The user will be able to access the e-wallet and to use the relevant functionalities via the application.
5.11 A user in entitled to:
a) keep e-money in the electronic wallet for an indefinite period.
b) cash out money from Bono Pay's office.
c) in case if e-money is available in the electronic wallet, once the provider confirms the payment order initiated by the user and prints it out, cash may be deposited or withdrawn from the cash desk.
d) if e-money is available in the electronic wallet, once the provider confirms the user-initiated payment order for withdrawing money from the electronic wallet, cash will be disbursed from the cash desk.
5.12 Bono Pay may block the e-wallet or suspend its use by the user any time if:
a) based on a reasonable suspicion, it believes that the payment services and electronic wallet may be applied by the user for legalizing illicit income.
b) it discovers that before signing the contract, the user identification was not properly performed.
c) it discovers that the user is trying to cash out or spend an unauthorized amount not belonging to the user and credited to his/her account due to systemic error.
Article 6. Important information
6.1 The number of points accumulated in different partner companies may vary or may change at any time.
6.2 Any disclaimer made by the partner company to the user does not mean that such disclaimer is made by the company. As such, the company bears no responsibility thereof.
6.3 In case if the registered user changes his/her personal mobile number, he/she should request change of mobile number in the database in the shortest time possible, so that he/she can continue to accumulate and spend points in the Bono application without any disruptions.
6.4 If an unregistered user changes the mobile device, the accumulated points and information will be lost; while in case of the registered user, he/she will manage to access his/her account in the application with his/her registration data.
Article 7. Confidentiality
7.3 By signing this agreement, the user agrees that his/her personal data will be registered in the application database, they will be compared with the databases of the partner companies, and upon detecting matches, the user’s data available at the partner company will be reflected in the application.
7.2 The company undertakes that the user's personal data will be duly protected, they will not be alienated or shared with non-partner companies or third parties.
7.3 In case if the user requests cancellation of his/her personal account and termination of this agreement, the data collected within the scope of the agreement will be archived and will not be used for operational purposes, other than the production of statistics.
Article 8. Unilateral termination of the agreement by the company
8.1 If the user fails to comply with the terms and conditions contained herein, or deliberately provides the company with false information and/or misuses the application, the company is entitled to unilaterally terminate the agreement.
8.2 The company is also entitled to unilaterally terminate the agreement in other cases defined by the effective laws of Georgia.
